Crutchfield Online Community Online Forums and Blogs

In order to participate in Crutchfield's Online Community you must agree to all of the following terms and rules, our privacy policy and our terms of use. If you do not agree to abide by all of these terms and rules, do not access the forums or blogs.

  1. Privacy and use of Personal Information: Any information which you provide is provided voluntarily. Crutchfield may use this information in any way allowed by its privacy policy.
  2. Crutchfield's Online Community is intended solely for residents of the United States who are thirteen (13) years of age or older and by using the site you are warranting that you are thirteen (13) or older. Any use of the site by anyone under thirteen (13) is a violation of these Terms.
  3. You acknowledge and agree that Crutchfield's Online Community is a public forum which may be, but is not required to be, reviewed and/or monitored by Crutchfield. Because of this there may be postings that contain material that may be offensive or objectionable to you. If you do not wish to see these postings, do not use Crutchfield's Online Community. Furthermore, you acknowledge and agree that you understand that any links to third party sites are not controlled or maintained by Crutchfield and that, should you visit such sites, you will be subject to that site's privacy policy (if any).
  4. You acknowledge and agree that you are granting an irrevocable, perpetual, non-exclusive, transferable, fully paid, worldwide license that Crutchfield may sublicense to all material that you post on Crutchfield's Online Community (and you are agreeing and representing that you have the right to grant this license). You acknowledge and agree that Crutchfield may use, copy, publicly perform, publicly display, reformat, edit and distribute any material you place on the Online Community for any purpose and in any way in Crutchfield's sole discretion and to prepare derivative works from the material or incorporate this work into other works.
  5. Crutchfield may change these terms and rules at any time without any notification by posting revised rules at this location. You should check the site regularly to see if changes have been made.
  6. Crutchfield's Online Community is for non-commercial, personal use only. You warrant and agree that you will not post any material that violates or infringes the rights of any third party, Crutchfield, or other users of the Crutchfield Online Community including copyright, trademark, privacy, publicity or any other rights, nor contains libelous, defamatory or unlawful material, and you agree and warrant that you will hold Crutchfield harmless and indemnify Crutchfield fully, including reasonable attorney's fees, if you should violate any of these terms and rules.
  7. You agree that you will not make available any content in any way that Crutchfield, in its sole and absolute discretion, considers to be harmful, infringing, illegal, abusive, inflammatory, vulgar, obscene, fraudulent, or objectionable in any way.
  8. You agree that you will only register one user account for yourself and will not provide any false or inaccurate information when registering for the account.
  9. You agree that you will not make available any advertising, spam, chain letters, pyramid schemes or any other type of solicitation on Crutchfield's Online Community.
  10. You agree that you will not make available any private, personally identifiable information of any third party including email addresses, telephone numbers, credit card numbers, addresses or Social Security numbers.
  11. You agree that you will not make available any material that contains software viruses or any other software that is intended to limit the functionality or control over any electronic equipment.
  12. You agree that you will not intimidate, harass, or belittle any other user and will not make available any content that, in the sole view of Crutchfield, is illegal, offensive, objectionable or attempts to inform any user how to bypass any safety features of any product.
  13. You agree that you are solely responsible for anything that you make available on Crutchfield's Online Community or which you transmit or share with other users and that you will indemnify and hold Crutchfield harmless for any such postings. Crutchfield may (but is not required to) monitor any User content prior to its posting or after its posting on Crutchfield's Online Community and may, at Crutchfield's sole discretion, modify, edit, comment on or remove that posting for any reason or no reason.
  14. Crutchfield's Online Community may be unavailable from time to time for maintenance, upkeep or other reasons. Crutchfield assumes no responsibility for any error, omission, interruption, deletion, defect, theft, unauthorized access to or any alteration of Your communication and postings on Crutchfield's Online Community or for damage to your computer resulting from the use of Crutchfield's Online Community.
  15. Copyright Complaints: Copyright Complaints may be emailed to community@crutchfield.com or sent to Crutchfield Community Manager, 1 Crutchfield Park, Charlottesville, VA 22911. If you believe that any material on Crutchfield's Online Community infringes upon a copyright which you own or control, you may send us written notification of the alleged infringement which must include the following:
    1. A physical or electronic signature of a person stating that the information in the notification is accurate and under the penalty of perjury that he is authorized to act on behalf of the owner of the material that is allegedly infringed.
    2. A statement from the complaining party stating that he has a good faith belief that use of the material in the manner complained of is not authorized by the copyright holder, its agent or the law.
    3. Identifies the copyrighted work(s) that is (are) allegedly being infringed and enough information so that we are reasonably able to locate the material.
    4. Sufficient information to allow us to contact the complaining party such as an address, telephone number and/or email address.

CRUTCHFIELD'S ONLINE COMMUNITY AND ALL OF ITS CONTENT ARE PROVIDED "AS-IS" AND CRUTCHFIELD DISCLAIMS ANY AND ALL REPRESENTATIONS AND WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION IMPLIED WARRANTIES OF TITLE, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT. CRUTCHFIELD NEITHER GUARANTEES NOR PROMISES ANY RESULTS FROM THE USE OF CRUTCHFIELD'S ON-LINE COMMUNITY AND DOES NOT REPRESENT OR WARRANT IN ANY FORM THAT CONTENT AND/OR MATERIALS ON CRUTCHFIELD'S ONLINE COMMUNITY ARE ACCURATE, RELIABLE OR ERROR FREE.

LIMITATION ON LIABILITY

EXCEPT IN JURISDICTIONS WHERE SUCH PROVISIONS ARE RESTRICTED IN NO EVENT WILL CRUTCHFIELD, ITS DIRECTORS, EMPLOYEES OR AGENTS BE LIABLE TO A USER OR ANY THIRD PARTY FOR ANY INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL OR PUNITIVE DAMAGES, INCLUDING ANY FOR LOST PROFITS ARISING FROM THE USE OF CRUTCHFIELD'S ONLINE COMMUNITY OR OTHER MATERIALS ON OR ACCESSED THROUGH CRUTCHFIELD'S ONLINE COMMUNITY EVEN IF CRUTCHFIELD IS AWARE OR HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN ANY CASE CRUTCHFIELD'S LIABILITY TO YOU FOR ANY CAUSE WHATSOEVER SHALL BE LIMITED TO THE AMOUNT, IF ANY, PAID BY YOU TO CRUTCHFIELD FOR YOUR USE OF CRUTCHFIELD'S ONLINE COMMUNITY.

CERTAIN STATE LAWS DO NOT ALLOW LIMITATIONS ON IMPLIED WARRANTIES OR THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES. IF THESE LAWS APPLY TO YOU, SOME OR ALL OF THE ABOVE DISCLAIMERS, EXCLUSIONS OR LIMITATIONS MAY NOT APPLY TO YOU AND YOU MAY HAVE ADDITIONAL RIGHTS.

Governing Law: These terms are governed and construed by the laws of the Commonwealth of Virginia without regard to conflict of law rules. If any portion of these terms are found to be unenforceable the remaining terms will remain in full force and effect.

Postings: You agree and acknowledge that anything of any nature whatsoever that you post on Crutchfield's Online Community is not privileged or confidential and will become the sole property of Crutchfield, which will own all rights including all intellectual property rights, and may use the material in any way it wishes to including commercial purposes without your acknowledgement and without compensation to you.
