The following terms and conditions (these "Terms and Conditions") contain important information regarding the Crutchfield Corporation ("Sponsor") Rewards program (the "Program"). Please read the following terms and conditions carefully. These Terms and Conditions are a binding agreement between you and Sponsor and will govern your participation in any and all Program offers.
Being eligible for the Program entitles Crutchfield Customers ("Customers") to take advantage of certain Program offers and/or points that may change from time to time (the "Program Offers/Points"), and which may be made available for limited times, all as determined by Sponsor in its sole discretion. Sponsor reserves the right to modify these Terms and Conditions at any time, without notice to you, so it is important to check these Terms and Conditions periodically. Participation in the Program and/or redemption of Program Offers/Points is considered acceptance of these Terms and Conditions and any modified terms included therein. Sponsor may, in its sole and absolute discretion, cancel, change, suspend or modify any aspect of the Program and/or any Program Offer/Points at any time, including the availability of any Program Offer/Points, without notice.
To be eligible for Program Offers/Points, you must purchase products from Crutchfield and be a legal resident of the United States of America, its territories and/or possessions and be at least eighteen years old. However, Crutchfield Corporation is not selling Points to you and you do not pay anything for the Points. Points are in the nature of coupons, awarded to you when you pay the purchase price of products Crutchfield offers for sale to you. Points have no monetary value and cannot be converted into cash. Points cannot be used to pay for any federal, state, and/or local taxes or fees of any kind that you may owe when a product or service of any kind is purchased from Crutchfield.
You must create an account at Crutchfield.com (there is no fee for creating an account) which will be subject to the terms of use for Crutchfield accounts and the Crutchfield privacy policy (as amended) located at https://www.crutchfield.com/support/privacy.aspx. Employees of Sponsor, Sponsor affiliates and their immediate family members living in the same household of Sponsor are not eligible for Program Offers/Points.
There will be no cash substitute for Rewards Points and Rewards Points cannot be redeemed for cash, used to purchase anything except physical items (including but not limited to no purchases of services, extended warranty programs, Gift Cards and/or Merchandise certificates) or transferred to any other individual and/or entity.
Sponsor may, in its sole and absolute discretion, cancel, change, suspend or modify any aspect of the Program and/or any Program Offer/Points at any time, including the availability of any Program Offer/Points, without notice. Sponsor may, in its sole and absolute discretion, terminate or suspend any Subscriber's participation in the Program for breach of these Terms and Conditions, or for taking any actions that are inconsistent with the intent of these Terms and Conditions. Sponsor shall be the sole determiner in cases of suspected abuse, fraud, or breach of these Terms and Conditions or intent of these Terms and Conditions. Any decision Sponsor makes relating to termination or suspension of any Subscriber's participation in the Program shall be final and binding in all respects.
The Program and/or the Program Offers/Points are void where prohibited or taxed by law. Sponsor is not responsible for any failures or circumstances affecting, disrupting or corrupting the Program of the Program Offers/Points in any manner including without limitation, Subscribers' ability to participate in the Program or any Program Offers/Points. Sponsor is not responsible for unavailable network connections; failed, incomplete, garbled or delayed computer transmissions; online failures; hardware, software or other technical malfunctions or disturbances; or any other communications failures or circumstances affecting, disrupting or corrupting the Program in any manner and Sponsor is also not responsible for any damage to any Subscriber's computer occasioned by participation in the Program or downloading of any information necessary to participate in the Program. By participating in the Program, Subscribers release Sponsor, its parent, subsidiaries, affiliates, suppliers, and agents from any and all liability for any loss, harm, damages, cost or expense, including without limitation property damages, personal injury and/or death, arising out of participation in the Program and the use of or participation in any Program Offers/Points. Sponsor makes no warranty in any respect as to any merchandise or service available within the Program. Program Offers/Points may be taxable, depending on the federal, state, and local tax laws applicable to you. You are solely responsible for reporting such items on your tax returns and paying any associated tax liability. You may not assign or transfer any Program Offers/Points. The redemption of points totaling 200,000 or more must be done by phone by calling us toll-free at 1-800-955-9091.
Subscribers are responsible for maintaining the confidentiality of their account username and password. Sponsor has no control over the Internet and cannot prevent the interception of messages by unauthorized parties or guarantee that such unauthorized parties may not be able to decrypt encrypted messages. Accordingly, under no circumstances will Sponsor be responsible for any loss or damage incurred by any Subscriber as the result of unauthorized interception or decryption of information transmitted to or by Sponsor. Subscribers must immediately notify Sponsor of any known or suspected unauthorized use(s) of a Subscriber's account, or any known or suspected breach of security, including loss, theft, or unauthorized disclosure of Subscriber's password. Personal nonpublic information that we gather from you in connection with the Program or otherwise will be governed by our Privacy Policy, and your use of the Crutchfield website and setting up a Crutchfield account will otherwise be governed by Crutchfield's Terms of use, available at https://www.crutchfield.com/support/termsofuse.aspx.
To join our Rewards program, you will need to create an account with Crutchfield and opt-in to the program. For purposes of administering our Rewards program, the contact information (name and email address) from this account will be used to assign program benefits and/or communicate with you about the Rewards program. As the Rewards program awards points based on your order history and any referrals that you make, Crutchfield will also maintain a history of your prior orders and referrals in order to administer the program. We do not assign a monetary value to the data we collect while operating our Rewards program. However, to the extent our Crutchfield Friends program is considered a financial incentive program under California law, we estimate that the value of the personal information you provide to us is reasonably equivalent to the dollar off amount provided to you. We estimate the value of consumers' personal information by considering the expenses incurred by the business related to the collection, storage and retention of consumers' personal information in the context of the financial incentive program and the expenses related to the provision of the financial incentive.
Occasionally, Crutchfield may work with social media platforms to show targeted advertisements to our customers with Rewards points. To do so, we make use of a hashing algorithm which masks your email address. We do not share your name, order history or referral history when showing these advertisements through social media outlets. If you would prefer not to receive targeted advertisements, you may opt out of advertising cookies via the Do Not Sell or Share My Personal Information page. Please note that if you de-activate targeted advertising, the advertisements you see will be less tailored to you and your interests, but you will still see some advertisements.
You may opt out of our Rewards program at any time by calling us toll-free at 1-800-955-9091. If you make a verified request to delete your data, please be advised that, once we comply with your request, the only personal information we will retain of yours is a record of your request itself. Your order history, name, and contact information will be deleted or anonymized along with the rest of your information, making it impossible to administer our Rewards program as we cannot tie you to any of your past orders. We provide advance notice of this result in our request for verification and suggest that you use up your Rewards points immediately so as not to lose them, assuming you wish to pursue your request to delete. We are also happy to work with customers who only want a subset of their data deleted, or corrected, that is not necessary to program administration.
